1) Scope

1.1 These Terms & Conditions (“Terms”) apply to all contracts for the sale and delivery of products entered into between you (“Customer”) and Alivion (“Seller,” “we,” “us,” or “our”) through our online store.

1.2 These Terms also apply to the purchase of vouchers or gift cards, unless otherwise stated.

1.3 A consumer is any natural person who makes purchases for personal and non-commercial purposes.

1.4 A business customer is any natural person or legal entity that makes purchases in connection with commercial or professional activities.

2) Contract Formation

2.1 The products displayed on our website do not constitute legally binding offers, but rather invitations to place an order.

2.2 By placing an order, you submit a binding offer to purchase the selected products.

2.3 We may accept your order within five (5) days by:

  • sending an order confirmation by email or in writing,
  • shipping the products, or
  • requesting or processing payment.

The contract will be considered concluded when the first of these actions occurs. If we do not accept the order within five (5) days, it will be considered rejected.

2.4 Payments may be processed through Shopify Payments, Stripe, PayPal, or other available payment methods. The contract may be concluded following successful payment authorization.

2.5 The language of the contract is English.

2.6 You are responsible for providing a valid email address to receive order confirmations and other communications.

3) Right of Withdrawal

3.1 Consumers may have the right to withdraw from a purchase within fourteen (14) days, where applicable.

4) Prices and Payment Terms

4.1 All prices are displayed in USD and include applicable taxes unless otherwise stated. Shipping costs are displayed separately.

4.2 The available payment methods will be displayed during checkout and may include third-party providers that are subject to their own terms and conditions.

5) Shipping and Delivery

5.1 Products will be delivered to the address provided during checkout.

5.2 If delivery fails because of incorrect information or circumstances attributable to the Customer, additional costs may be charged.

5.3 The risk of loss passes to the Customer upon delivery. For business customers, the risk passes when the products are handed over to the carrier.

5.4 If we are unable to fulfill an order due to supply issues beyond our control, we may cancel the order and issue a full refund.

5.5 We do not offer local order pickup.

6) Retention of Title

All products remain our property until full payment has been received.

7) Warranty and Liability for Defects

7.1 Customers are entitled to all applicable statutory warranty rights.

7.2 For business customers, warranty periods may be limited to one (1) year where permitted by law.

7.3 Consumers retain all rights granted under applicable consumer protection laws.

7.4 Exceptions may apply in cases involving fraud, concealed defects, or mandatory updates for digital products.

7.5 Business customers must inspect the products upon delivery and report any defects immediately.

7.6 Consumers are encouraged to report visible damage caused during shipping as soon as possible, although this is not mandatory.

8) Personalized Products

If you provide content such as text, images, or designs, you represent that you have the legal right to use that content. You agree to indemnify us against any third-party claims resulting from an infringement of those rights.

We reserve the right to reject content that is illegal, offensive, or otherwise inappropriate.

9) Promotional Codes

  • Promotional codes are valid only for a limited period and exclusively in our online store.
  • Only one promotional code may be used per order.
  • Promotional codes cannot be redeemed for cash.
  • Promotional codes cannot be applied retroactively.
  • Promotional codes are non-transferable unless otherwise stated.

10) Gift Cards

  • Gift cards may be used in our online store.
  • They are valid for three (3) years from the date of purchase.
  • Only one gift card may be used per order.
  • Gift cards cannot be redeemed for cash.
  • Gift cards may be transferred unless misuse is suspected.

11) Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. The mandatory consumer protection laws of your place of residence may continue to apply.

12) Dispute Resolution

We are not required to participate in consumer arbitration proceedings. However, you may have the right to pursue claims through any legal remedies available to you.
